    What do you actually hope to accomplish?

    A: Several things, and we try to be realistic about all of them. We want to win the cases, of course. But we also want to challenge the things we think need to be challenged.

    In the short term: build a documented record of cases involving patient harm in PE-owned hospital systems, organized in a way that’s useful to journalists, legislators, researchers, and other advocates.

    In the medium term: get that record in front of people in Congress who have both the interest and the authority to do something with it. Contribute to a legislative conversation that’s already starting to happen, just not fast enough.

    We are challenging two specific things we think need to be corrected: 1. Good faith / affidavit of merit requirement before a health care liability claim can be brought in Tennessee, and 2. Cleland v Bronson case being used to dismiss EMTALA claims.

    In the long term: be part of a broader shift in how the public understands the relationship between financial engineering and patient outcomes. How many people know what’s really happening when a private equity firm has billions of dollars in debts, and the patients are their investment and debt management strategy while the executives and shareholders make themselves wealthy? We think people generally know this is happening, but not necessarily how it is happening. We want to change that.

    Are we going to fix American healthcare? No. PAC money goes to Congress and state lawmakers, so we know they aren’t going to bite the hands that feed them. Are we going to make a documented, public, organized case that something is wrong and that ordinary people noticed? Yes. We already are.

    That feels like enough of a reason to keep going.
